General conditions of Sale
Premise
These conditions for the supply of products and images apply in full to every order except for written exceptions communicated by FOTOPRINT to the Customer. The placing of the order implies the full acceptance of these general conditions of sale.
Prices
The prices indicated on our site are indicative and may be subject to change without notice. In any case, the price that will be shown on the order confirmation that will be sent to the customer following the sending of a purchase order will prevail.
The prices indicated on all pages of our site are, unless otherwise indicated, VAT INCLUDED or, in the case of used or antique equipment, EXEMPT VAT pursuant to Article 36 of Legislative Decree 41/95.
Prices do not include shipping costs except in cases where it is expressly proposed and agreed.
Sale of new or used equipment
New products benefit from the guarantee offered by the importer or the parent company.
The goods sold as used or antiques are sold with a VISA AND LIKED clause or they can be equipped with a FOTOPRINT guarantee in relation to the actual conditions of use and age found in the pre-sale checks where any aesthetic or functional defects are highlighted, therefore complaints are not accepted or returned outside these conditions or for the aforementioned defects declared by the seller at the time of the order, without prejudice to the faculties that the buyer may exercise by law.
Postal dispatch of orders
The shipping time varies from 2 to 10 working days depending on the orders that FOTOPRINT has in process, the delivery, once the material has been shipped, will take place in 3/6 working days by postal service or by courier, except for delays attributable to the manager of the logistics (Courier or Italian Post Office). The goods vtravel at the total risk of the client.
Sale of printed images or files
The images purchased as printed photographs can be collected at the FOTOPRINT sales point, or they can be sent to your home in the manner and conditions mentioned above. The purchased image files can be physically collected on a hardware support suitable to contain them at the FOTOPRINT sales point or they can be sent, to the buyer who requests it, via WEB at no additional cost.
The buyer accepts the images, as well as the files that contain them, in the state in which they are found, with all possible errors, defects, inaccuracies and without guarantees of any kind. The supplier expressly excludes, in relation to the images, as well as the files that contain them, any guarantee or condition, express, implied or statutory, including, among others, the implied guarantees and / or conditions of marketability, of satisfactory quality, suitability for a specific purpose, exemption from flaws or defects, precision, enjoyment free from disturbances and non-violation of the rights of third parties. Except for the mandatory limits of the law, the responsibility of FOTOPRINT for defects or faults in the service, images and files containing them is limited, at the discretion of the company, to the remaking of the prints or to the replacement of the files and, only when this was impossible, to reimburse the sum paid by the purchaser. The buyer is solely responsible towards himself or third parties for all damages, none excluded, direct or indirect, deriving from the contract or from its execution or from the use of the images. Likewise, the purchaser is solely responsible for the violation of the rights of personality and property committed using the images covered by this contract. The buyer will indemnify FOTOPRINT, as well as the photographers involved, from any damage or liability deriving from a use of the images other than that authorized in this contract. This clause regarding the guarantees and the liability regime is not intended to limit the liability of the company in violation of legal provisions, nor to exclude it in cases where it cannot be excluded by virtue of these provisions.
